Success in the EAT in important decision concerning the Employment Tribunals’ obligations under international treaties

Richard Owen-Thomas was successful in the EAT on 18th January 2012 against Leading Counsel in the case of Zarkasi v Anindita (EAT), which upheld the Employment Tribunal’s decision to dismiss all the Claimant’s claims.
The EAT was persuaded that the common law doctrine of illegality was not displaced by considerations of a Council of Europe Convention.
A full case report will follow once the judgement is reported.
