Roger Ellis has more than 40 years’ experience of commercial litigation and arbitration, covering inter alia all aspects of commercial leases, franchise agreements, national and international banking and financial matters.

CAREER PATH

He was a founder member of the professional chambers at 13 King’s Bench Walk in 1971, from where he still practices.  He became a QC in 1996.

He lectured at the Holborn College of Law in London in Company Law, Conflict of Laws and Conveyancing for the external LLB degree of the University of London and the Law Society’s final examinations.

He commenced legal practice in 1962 in the Chambers of Mr G R F Morris QC.

He graduated from the University of London in 1961.

 

PROFESSIONAL PRACTICE EXPERIENCE

His professional practice has covered

  • All forms of commercial litigation, particularly with regard to commercial leases.
  • He has been involved in numerous arbitrations, both in the United Kingdom and abroad.
  • Considerable experience in litigation involving restraint of trade and franchise agreements.
  • Extensive involvement in company and insolvency matters, and litigation involving banking and international financial services, particularly in the Cayman Islands.
  • All aspects of vendor and purchaser disputes.
  • Matters of dispute involving partnerships, professional negligence and contracts
  • He sits on inquiries for the Parliamentary Boundary Commission

 

LEADING AND IMPORTANT CASES

In England, his court practice is in the High Court of Justice and the Appellate Courts where he has been involved in major litigation for a considerable number of years.  Some of the leading cases in which he has been involved include: Coronation Street Industrial Properties Ltd v Ingall Industries Plc [1989] 1 WLR 304 (House of Lords) concerning the liability of a surety under a lease on the insolvency of the lessee.  Dukeminster (Ebbgate House One) Ltd v Sumerfield Property Co Ltd [1997] 2 EGLR 125 (Court of Appeal) concerning the rent review of a retail distribution warehouse.  El Ajou v Dollar Land Holdings [1994] 2 All ER 685 (CA) (tracing against a constructive trust deed).

In addition to commercial arbitrations in England, he has also conducted arbitrations in Sweden and France.

He has particular knowledge of and experience in dealing with disputes in the Cayman Islands. He has advised and acted for the Government of the Cayman Islands in relation to the financial regulation and suspension of a Cayman Island Bank.  He has conducted an enquiry on behalf of the Government into aspects of the insurance industry in the Cayman Islands and its statutory regulatory body.   He has also advised the CIBC Bank and Trust Company (Cayman) Ltd concerning a guarantee issued by the bank, and concerning alleged fraud in relation to a trust administered by the bank.
