EMPLOYMENT AND COMMERCIAL                           

Timothy is an employment and commercial law barrister who negotiates complex legal disputes on behalf of clients. He combines robust and tenacious advocacy with outstanding collaborative skills. Timothy takes a commercial approach, and he is alive to the specific concerns and priorities of each individual client in the diverse sectors of the public and private economy. He acts for a wide range of entities from large European companies to local authorities and private individuals. As employment law continues to develop at a rapid speed, Timothy provides an early, clear and comprehensive legal and tactical analysis, anticipating potential challenges and suggesting routes to success, that allows clients to approach each case with confidence.

Recent cases: 

  • Acting for a respondent European telecoms company against a former director in a whistleblowing claim. Timothy successfully defended the claim at a full hearing, after the claimant had obtained a Continuation of Contract Order at the interim stage.  
  • Representing a Commodities Derivatives Trader against a European bank in relation to a high value disability and sex discrimination and contractual bonus claim at London Central Employment Tribunal.  
  • Ashby v Monterry Designs Limited, Appeal No. UKEAT/0226/08/CEA. An appeal to the Employment Appeal Tribunal regarding a claimant’s status as both a director and employee of a company as defined by section 230 of the Employment Rights Act 1996.  
  • A cross-border dispute between an international company and a former British employee based in Cyprus, involving a range of chancery remedies.  
  • Acting for a London local authority respondent in relation to an equal pay claim by a female administrator by reference to the 1987 Green Book.  
  • A contractual dispute between a London local authority and a household name recruitment agency (Employment Business) in relation to fees charged pursuant to the Conduct of Employment Agencies and Employment Business Regulations 2003. 

Timothy contributes articles to employment law journals and gives client seminars on current developments in employment law.

PROPERTY AND PUBLIC LAW

Timothy also assists clients in the fields of property and public law, including licensing and judicial review cases. He represents both commercial and social landlords in relation to housing matters, boundary disputes and possession proceedings including forfeiture. Timothy is regularly instructed by local authorities and businesses to spearhead licensing applications and appeals.

Timothy accepts work under the Public Access scheme for barristers.

- NORTON ROSE
Timothy qualified as a solicitor at Norton Rose before transferring to the Bar in 2004. He worked on both contentious and non-contentious matters in the fields of international commercial litigation and arbitration, competition, corporate finance, banking and employment law.  

In the field of employment law he assisted on a TUPE multi-million pound group action.  He also undertook several matters on behalf of employees as a Free Representation Unit representative.

 - US DEATH PENALTY CASES
In 2001, sponsored by the anti-death penalty charity Amicus, Timothy worked in the Oklahoma County Public Defender Law Office with attorneys on capital murder cases in the state of Oklahoma and on subsequent appeals to the US Federal Courts.

LANGUAGES

French (bilingual). Having studied in France for two years and worked in the Norton Rose Brussels office in 2003, Timothy takes a keen interest in European employment law and its implementation into domestic legislation. As a fluent French speaker, he enjoys acting for French and Belgian companies and individuals.
