Richard Owen-Thomas' successful appeal in Padden v Bevan Ashford (a firm)

In an important case which helps clarify solicitors' duties to vulnerable clients the Court of Appeal has decided in Padden v Bevan Ashford that a solicitor who certifies that legal advice has been given to a client of the firm must  take steps to ensure it has.

RBS v Etridge duties can arise whenever a solicitor is presented with a transaction which may be tainted by undue influence regardless of the circumstances in which the solicitor is involved.Â
